*All depositions must be 2 hours in length.
** To receive your Montblanc pen: (i) the deposition must be at least 3 hours long, (ii) the attorney must be available to personally receive the pen on behalf of the firm, (iii) the transcript charge must be paid in full, (iv) the booking attorney must be a new client, and (v) the deposition must be booked before 12/31/08. Limit one pen per new client.
Prior to running any promotion, Capital Reporting Company reviews the applicable rules of professional conduct and ethics opinions to make sure that our giveaways” are appropriate. The key issue is always whether our rates are “reasonable,” and in fact, our rates tend to be among the bottom 25% in the Washington, D.C. Metropolitan area. Rule 1.5 of the Model Rules (as adopted) is the only rule on point which seems to potentially address the matter. If the fees for the vendor’s services are “reasonable” and in line with what other similarly situated vendors charge, then the giveaway is absolutely appropriate. Essentially, the vendor - whomever it may be - is simply willing to give some of its profit back to the client as a way of cultivating goodwill.
