New Rules for Changing Deposition Testimony

This past summer the Maryland Court of Appeals adopted new rules for changing deposition testimony. The rules change became effective July 1, 2004. Now, under Rule 2-415, a witness can make a substantive change to answers that the witness gave in the deposition. This means that a witness can give testimony under oath, and later alter the actual substance of the deposition.

The procedure for making the substantive changes is straightforward. First, the change must be made within 30 days of the date that the deposition was mailed or otherwise submitted to the deponent. Second, the deponent must execute a "correction sheet," which becomes part of the record. The correction sheet must state why each change is being made.

In the event a substantive change is made to a transcript, any party may serve notice that the party wishes to take a further deposition of the deponent. This does not mean that the witness can be re-deposed on any point; rather, the deposition must be limited to the subject matter of the substantive change.

This rules change now makes the Maryland rule comparable to the Federal Rule 30(e).
